Terms of Service

These Terms of Service ("Terms") govern your access to and use of Burd, including the Burd mobile apps, the Burd web app, and the Burd marketing website (collectively, the "Service"), operated by Feath AI ("we", "us", "our"). By creating an account or using Burd, you agree to these Terms. If you do not agree, do not use the Service.

Who can use Burd

You must be at least 13 years old (or the minimum age required in your country) to use Burd. If you are under 18, you represent that you have permission from a parent or guardian. You may use Burd only if you can form a binding contract and are not barred from using the Service under applicable law.

Your account

  • You are responsible for keeping your login credentials secure.
  • You must provide accurate account information and choose a username that does not impersonate others.
  • You may delete your account at any time from Profile → Settings → Delete account in the app.
  • We may suspend or terminate accounts that violate these Terms or harm the community.

Your content

You retain ownership of photos, audio, notes, and other content you post ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute it as needed to operate Burd (for example, showing your sightings in feeds and on your profile).

You agree not to post content that:

  • Violates any law or third-party rights.
  • Is harassing, hateful, sexually explicit, or otherwise harmful.
  • Contains malware, spam, or deceptive identification claims presented as fact without good faith.
  • Misrepresents wildlife locations or data in a way that could mislead conservation or safety efforts.

Community and safety

Burd includes social features such as follows, comments, and notifications. Treat other birders respectfully. We provide reporting and moderation tools and may remove content or restrict accounts that violate these Terms or our community standards.

Bird identification features

Photo ID, sound ID, field guide content, and AI-assisted species information are provided for educational and recreational birding. Predictions may be incorrect. Do not rely on Burd for safety-critical, legal, scientific, or conservation decisions without independent verification.

Location and notifications

Some features use device location or send push notifications. You can control these permissions in your device settings. Location you attach to sightings may be visible to other users according to how you publish content.

Acceptable use

You agree not to:

  • Reverse engineer, scrape, or overload the Service or its APIs.
  • Use automated means to create accounts or manipulate rankings without permission.
  • Access another user's account without authorization.
  • Use Burd for unlawful surveillance, stalking, or harassment.

Third-party services and data

Burd may rely on third-party infrastructure, open data, and machine learning models. Third-party terms and licenses may apply to underlying data or software. See the in-app Data sources screen for attribution details.

Intellectual property

Burd's name, logo, app design, and original materials are owned by Feath AI or our licensors. These Terms do not grant you rights to our trademarks or branding except as needed to use the Service normally.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE, OR FULLY ACCURATE OPERATION.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEATH AI AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF BURD. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY ZERO FOR FREE USE).

Termination

You may stop using Burd at any time and delete your account in the app. We may suspend or terminate access if you breach these Terms or if we discontinue the Service. Sections that by nature should survive termination (such as disclaimers and limitations of liability) will survive.

Changes

We may update these Terms from time to time. We will post the revised version with an updated "Last updated" date. Continued use after changes become effective means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Canada, without regard to conflict-of-law principles, except where mandatory local consumer protection laws apply in your country of residence.
